Obtaining unowned land in Scotland?
My flat comes with a car park I have a shared ownership of. Next to the car park is a piece of unused land about 1 acre. Its never been maintined and after some investigation I have found there is no clear title to it. It is part of the large estate my flat is in and the land office in Glasgow have advised me it was owned by the builder however the title deeds for each property in the estate states there is communal land within the estate and this is maintained by the council. This piece of land has no clear ownership title and has never been maintained. I
believe as I own land next to it (shared car park on one side and my flat on the other) I can claim it is this true? has anyone ever done this before and it worked out?
You should contact your solicitor and your local Councillor (http://www.glasgow.gov.uk/en/YourCouncil/Council_Committees/Councillors/) to ask this question directly. Your Councillor might be aware of other potential parties that may be trying to lay claim to the land, especially if it is maintained by the Council.
Your solicitor will help you (and the other residents in your building) draw up a claim to the land, but this can be challenged in court, which can take years - which is why contacting your Councillor early is a good idea. (I know this because a plot of land adjacent to my house was left to our local community and has been tied up in court for over a decade - now the land is worth millions.)
However, it might be a straightforward issue which would add value to your property, so it is definitely worth pursuing. You may have to end up paying a small amount to legally purchase the land, but in Glasgow this would be miniscule compared to the amount of return you would get if you ever decided to sell!
